The terms and conditions as set out herein constitutes an agreement between the user and Company.

The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and all Agreements: “User”, “Customer”, “Client”, “You” and “Your” refers to you, the person log on this website and compliant to the Company’s terms and conditions. “Website/Mobile Apps”, “esastha”, “The Company”, “Ourselves”, “We”, “Our” and “Us”, refers to our Company. “Party”, “Parties”, “3^rd parties”, or “Us”, refers to both the Client and ourselves (including 3^rd parties). All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner for the express purpose of meeting the Client’s needs in respect of provision of the Company’s stated services, in accordance with and subject to, prevailing law of Bangladesh. Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to same.

The domain name www.esastha.com and the mobile application are collectively referred to as the Website.

What is eSatha?

E-SASTHA.COM is an online Health & medical platform that provide doorstep services like pharmaceutical/non-pharmaceutical products sold by various third party licensed pharmacies  and by the Company; (ii) diagnostic services being offered by various third party diagnostic centers (“Third Party clinics & hospitals”); (iii) online medical consultancy services/booking & second opinion being offered by third party diagnostic centers & independent doctors (BMDC Licensed). (iv) Nursing home services being offered by third party nursing agency and by the company; (v) Ambulance Service being offered by third party ambulance hire agency and by the Company. Our service using is very simple, just massage our website chat box or official Facebook messenger, or by customer care number +8801994032367 for any quires. A full dedicated team are waiting for your call/massage in 24/7.

Accepting terms:

You acknowledge and agree that, by using any service of our website or any content on the website, you are indicating that you have read, understand and agree to be bound by all the terms and conditions of this Agreement. If you don’t agree to all the terms and conditions of this Agreement, you shouldn’t, and aren’t permitted to, use the Service. If you accept or agree to these Terms of Service on behalf of a company or other legal entity, you represent and warrant that you have the authority to bind that company or other legal entity to these Terms of Service and, in such event, “you” and “your” will refer and apply to that company or other legal entity.

The Service is intended solely for persons who are 18 or older. Any access to or use of the Service by anyone under 18 is expressly prohibited. By accessing or using the Service you represent and warrant that you are 18 or older.

Use of the Service:

By registering and using the services you agree that you are eighteen years or above and you are not debarred by any law to contract and you agree to have read and accepted the terms and conditions provided herein and agree to be bound by our other policies. If you do not agree with any of the Terms, please refrain from using the Website.

Registration & Log in:-

1.    By accessing, browsing or using any service you agree that you are eighteen (18) years of age or older to use or visit the Website in any manner. If you are under the age of 18, you hereby confirm that you`ve legal guardians permission to use the website.

2.    In order to access or use the Website you must set up an account by providing information about  your personal and demographic information – which may including your name, gender, age, address, phone number, email address and your medical prescription(s) and such other details relevant for placing orders through your account.

3.    It is your responsibility to maintain the confidentiality of your Account Information and ensure that you log out of your account at the end of each session. You shall remain solely responsible for all the actions by you on your account.

4.    You will immediately inform us of any unauthorized use or security breach of your account, you may be held responsible for any losses incurred to eSastha or any other user due to unauthorized use of their account, resulting from your failure to keep your Account Information safe, secure and confidential. We reserve the right to refuse access to the Website, terminate or suspend accounts, remove or edit content at any time without providing any notice to you.

5.    We constantly monitor the user’s account in order to avoid fraudulent accounts and transactions. Users with more than one account or availing referral code fraudulently shall be liable for legal actions under the applicable law and we reserve the right to recover the cost of Products, transaction fees, or any other related cost including attorney fees, from such person using the Website fraudulently.

6.    You understand that once you have create your Account Information and successfully registered on the Website, you may receive SMS or email notifications from eSastha relating to your registration and transactions on the Website.

Uploading:

1.    We only review Valid Prescription from customer. We recommended you to upload a valid prescription of registered medical physician/practitioner Under BM&DC or Government Law. Uploading a image except Medical documents (nude or sexual or other documents) that violet our Uploading Policy will not be accepted.

2.    By Uploading Prescription Order not be placed until we have confirmed the order to you by phone, email or in writing.

Services:

Pharmacy:

All Our pharmaceutical/non-pharmaceutical products collected from partner licensed pharmacies and Departmental Store. Sold by us through its licensed premises (“Products”).

Diagnostic & Doctor Appointment:

We`ve partner various hospitals across the country where our customers can book Doctor appointment and get 10%-40% discount on the selected services i.e. pathology, radiology, hospitalization etc.

Nursing:

We`ve partner various Nursing Agency across the country.

Blood Donor:

We collected Donor Information only, we don`t store or sell bloods.

Ambulance:

We`ve partner various Ambulance and car hair Agency across the country.

Note: Third party services are not owned or control by the company, we are not responsible for the unsatisfactory service provide by the 3rd parties.

We strongly advise you to read and follow the all policies (T&C, Privacy etc.) of third parties service that you visit.

Third party services:

 Please note that our service is provided by third-party, and the Website does not guarantee nor make any representation with respect to the correctness, completeness or accuracy of such services. You should seek emergency help or follow-up care when required and continue to consult your primary health care provider as you may deem fit.

Order Delivery & Taking:

1.    Any Order not be placed until we have confirmed the order to you by phone, email or in writing.

2.    All orders are delivered subject to receipt of valid prescription and availability except OTC medicine.

3.    By Uploading Prescription Order not be placed until we have confirmed the order to you by phone, email or in writing.

4.    Prescription medicines will require a doorstep signature on your uploaded medical documents.

5.    If you placing an order for someone else you have to confirm that you`ve their authority to do so.

Our products will be delivered through a delivery agent without disclosing your personal information along with document directly to the patient or its authorized person.

Delivery chart:

*Emergency delivery is currently available within Aminbazar, Mirpur, kallaynpur, shaymoli, lalmatia, mohummadpur, adabor and dhanmondi only. Please contact our customer care at +8801994032367 for an emergency delivery.

Note:

1.    If any product will be up to 500gm, additional Tk. 30.00 added for each per kg.

2.    We reserve the right to reject any order.

Cancel, Return & Refund:

We strive to ensure your orders are delivered to your satisfaction. However, in the rare event that your order is unsatisfactory, we are happy to accept returns for orders.

We understand that there will be genuine reasons when you decide to cancel an order. You may cancel your order before delivery by calling customer care number +8801994032367.

If your product is eligible for a return or refund you can raise a return/refund request within 24 hours of delivery by calling us at +8801994032367.

1.    During order delivery, esastha’s delivery team requests every customer to verify the contents and provide an acknowledgment confirming the correctness and completeness of the order.

2.    Once the order is verified and acknowledged by the customer, the order in full or part cannot be returned unless there is a defect in the delivered order which is highly unlikely.

3.    It is always processed for the full order and invoice. We will not process partial delivery or returns.

4.    Some certain products (Diapers, insulin, cutting strip, short date of medicine, Injection, surgical items) will not be considered refundable.

5.    Refunds will be processed only for defective and incorrect deliveries.

6.    Received an item(s) that does not match your order.

7.    Damaged in transit or shortage (delivery of such order to be refused at doorstep)

8.    Expire within 2 months where the shelf life of the item is more than 2 months

9.    Developed any allergies after taking the medication and the doctor has prescribed another medicine, the medicines can be returned within seven (07) days from the date of delivery.

10. All returns items must be new, unused, and contain all original packaging and accessories i.e. with labels, bar-code.

11. Only fully unused strips/bottles/products can be returned.

12. Partially used strips, opened bottles cannot be returned.

13. Products which require specific storage conditions (temperature controlled) cannot be returned (vials, injections, vaccines, pen fills, etc)

14. Products that have expired post-purchase.

15. Batch number of the product being returned should match as mentioned on the sales invoice

16. Original sales invoice has to be returned for processing returns and refunds.

17. You need to submit or show your prescriptions/related papers while ordering or receiving medicines from us.

18. With an original receipt Items purchased at esastha.com may be returned within 7 days of purchase for exchange or refund.

19. You must bear the cost of the delivery charge if our team collects the medicine directly from your premises.

20. You will also have to bear the original and subsequent delivery charge for the return of the medicines or products, the esastha.com authority will not take any responsibility in this regard.

21. Where the customer desire to receive the refund amount via mobile baking transfer, in that case, the customer is obliged to submit his/her own mobile bank account number.

22. Using Cash on Delivery as the payment method, refunds can be processed to your mobile bank account (Bkash,Rocket,Nagod). It will take 1-2 working days.

23. If you notice the package is damaged at the time of delivery, please do not accept the order. If you could not check that the order is damaged at the time of delivery, raise a return request within 24 hours of delivery by calling us at +8801648462005 or 01304419901.

24. Replacement for the damaged item (s) is subject to availability in stock. In absence of a replacement, a refund will be issued through mobile banking account.

Any other Issues: You need to raise your concern by writing to us through E-mail or SMS while receiving an ordered package from us. In this special case, we may consider changing the medicine at our discretion.

Products Availability:

We providing you with an e-commerce website to purchase medical Product or avail third party services, if you deem fit. We cannot be more specific about availability. As we process your order, if any of the items on your prescription or you order are not available you will be informed by e-mail or mobile SMS/call if any Products you order turn out to be unavailable or out of stock.

Products Pricing:

All prices are listed in Bangladeshi Taka. Price, as displayed, is inclusive of all applicable taxes.

Offers, discounts, and incentives:

From time to time we may run discounts, offers, and promotions on our products & services. Esastha reserve the right to change, amend or withdraw these offers at any time.

Payment options and processing:

Mobile Banking: Once the order has been submitted, an invoice will be sent via email to the email address linked to the user account used to place the order. We do not hold or store any payment details. Payments are processed via the secure Mobile banking payment gateway.

Accuracy of Information:

We take care to ensure that all information available on our website about our business, services, and any products mentioned is accurate. However, these are continually developing and, occasionally, the information may be out of date. Medical, commercial and legal practice change frequently and the content on this website, in of any newsletters and in other items offering guidance have been prepared for general interest only and are not a substitute for specific medical, legal, or other professional advice and should not be read or used as such. 1.    You consent to receive communications, notifications and commercial messages regarding any transaction / marketing / promotional activities that are related to your transaction on the website or the Products and Services that maybe available on the Website from time to time. 2.    The Company does not provide any guarantee and will not be held liable or responsible for any failure to send such notifications/reminders to you.

3.    eSastha is not responsible for any unsatisfactory, delayed, non-performance or breach of the contract entered into between You and the Third Parties for purchase and sale of goods or services offered by such Third Parties on the Website;

Esastha will not therefore accept any liability in case of temporary or indefinite unavailability of the Site and Services. The information posted on the Site or in any communication, which we may send to you in accordance with our Privacy Policy, is indicative only and is not intended to be representations or advice on which you should solely rely.
